2010 Tier II Reports

Anderson County Industrial Facilities –

In 1986, the Superfund Amendments and Reauthorization Act (SARA) was signed into law.  Title III of SARA is also known as the Emergency Planning and Community Right-to-Know Act (EPCRA).  Section 311 of the EPCRA requires facilities that store more than the EPCRA threshold quantity of chemicals to submit a Tier II Emergency and Hazardous Chemical Inventory Form to Tennessee Emergency Management Agency (TEMA), Anderson County Local Emergency Planning Committee (LEPC), and the local fire department by March 1 of each year.  The LEPC uses this information to help develop an emergency response plan and must also make this information available to the public.

TEMA encourages Tier II facilities to use electronic reporting.  The easy E-Plan online reporting system will allow you to create a report you can submit to meet their requirement for filing of (SARA Title III) Tier II Emergency and Hazardous Chemical Inventory Reports.  The system is free to company managers required to file their Tier II reports each year.  Start by registering at the link below to obtain an Access ID and password. TN Public Acts Chapter 185 (House Bill 716) grants each LEPC authority to assess and collect fees of $100 annually from all industrial facilities that submit Tier II Reports.  An invoice is enclosed.  Please submit $100 to the Anderson County LEPC along with your Tier II Reports by March 1, 2010.

The fees collected by the Anderson County LEPC return to the community to support activities vital to safety.  In 2009, these fees were used to purchase 115 “Masters of Diasters” educator kits covering 11 topics for weather-related, geological, and human caused disasters.  The lessons address what to do before, during and after a disaster strikes when at school or home.  The kits were delivered to each K-8 grade in the Anderson County school system.  Additional information concerning our meetings and activities can be found on our website at www.andersonlepc.org.  Your support is appreciated.
